The Golden Rule: Simna Web Services, LLC (SWS) holds a zero tolerance policy for pornography, spam, warez and other actions deemed illegal by the United States Government. SWS may also ammend this agreement at any time without notice.

Responsibility of SWS
SWS assumes no responsibility for the content of accounts with SWS. SWS does however assume the right to suspend or terminate any account found to violate this agreement.

Regulations
The following list includes, but is not limited to, actions which are UNACCEPTABLE to SWS.

1. Content that includes, or is linked to pornography, nudity, sex, adult content, or extreme content.
2. Any actions which would be deemed illegal by the United States Government.
3. Participation in any hacking attempts, or the aide in the spread of worms, viruses, trojans, etc. which may affect the normal operation of SWS or any other computer on the internet.
4. Promotion of spam or any unsolicited e-mail.
5. Posting of any copywritten, or trademarks without complete written permission.
6. Any form of religion extremism.
7. The use of any IRC server.

Responsibility of the Account Holder
SWS provides web hosting services. The following is the responsibility of the account holder.

1. The account holder agreed to maintain thier account. This includes backup of all files, database, and any other items located within their web space.
2. Backup of accounts is not the responsibility of SWS. Only in the event of a system wide error is SWS responsible for maintaining updates. Backups are made on a weekly basis. Any more specific backup is to be maintained by the account holder.
3. SWS does not hold any responsibility for any failures, delay, or interruptions of content contain on SWS servers.
4. The account holder agrees to assume any fees that may result in the use of the services of SWS. This includes any legal fees or claims that may arise. This also includes any fees that may come about from the possession of copywritten or unlawful material.

Payment
Simna Web Services hereby proclaims that all accounts MUST have a payment subscription in order to have an active account. Exceptions to this occur only at the discretion of the Simna Web Services staff.

1. The billing contact for accounts is the person solely responsible for paying service fees. If someone other then the billing contact will be taking over payment for services, Customer Service must be notified immediately.
2. Simna Web Services does not offer nor guarantee any refunds for early termination of payment for a monthly subscription or for dissatisfaction of our services.
3. Simna Web Services reserves the right to pass along any fees that result from improper usage of our servers and/or internet connection to the account(s) that the improper usage originated from.
4. Simna Web Services also reserves the right to charge an account holder for any services that are rendered upon his/her account.

Access
All persons administering accounts must be at least 16 years of age.

This Acceptable Use Policy and any disputes arising out of or related to these services shall be governed by, construed, and enforced in accordance with all applicable laws.

Simna Web Services reserves the right to amend or change these guidelines at any time without notice.
